Terms of Service
Last updated 25 October 2026. Effective 14 October 2026 for accounts opened from that date, and 28 October 2026 for accounts opened before it.These Terms are published at thecollectibles.io/terms. In plain terms: every pack you buy gives you one real, physical collectible from that pack's pool, usually a professionally graded card. Buying a pack opens it, and an opened pack is final. Odds are published before you buy. You can ship what you pulled to your door or sell it; an item left in the vault is sold for you automatically four days after you bought its pack. Withdrawals of the proceeds of your sales normally arrive within 4 to 7 business days (section 7). The Marketplace sells cards and other items from shops that ship to your door. Live lets you watch creators open packs, and the app lets you scan cards, post and message other collectors, with no tolerance for objectionable content or abusive users. You must be 18 or older. These Terms also serve as the licence agreement for the app.
01Who we are and what these Terms cover
The Collectibles — the website thecollectibles.io and The Collectibles app for iOS and Android ("the app"), together "the Service" — is operated by Horde Inc., a Delaware corporation with its registered address at 2810 N Church St, STE 90840, City of Wilmington, County of New Castle, Delaware 19802, United States ("we", "us", "our").
These Terms are a contract between you and us. They apply to the website and the app, your account, every pack you buy or receive, everything you hold in the vault, every sale, every shipment, every Marketplace order, Live, the community features, the Partner programme and the Vendor programme. Our Privacy Policy at thecollectibles.io/privacy forms part of these Terms. If you sign a Partner Agreement, that agreement applies to the Partner programme alongside these Terms and prevails where the two conflict.
Packs are sourced from, and the items in them are stored and shipped by, our fulfilment partner Phygitals, Inc. and the vault operators it works with. Your contract for packs, the vault and shipments from the vault is with us, not with Phygitals. Where these Terms say a partner does something, we remain responsible to you for it under these Terms. Marketplace purchases from outside shops are different: see section 12.
You accept these Terms by creating an account, installing or using the app, or buying or opening a pack. The website's sign-up form asks you to accept these Terms and to confirm that you are at least 18, and the app's welcome screen tells you that continuing means accepting them. If you do not accept them, do not use the Service.
02Where the Service is available
Countries. We decide, country by country, where the Service is offered. In some countries it is not offered at all; in others it is not open yet and shows as coming soon. From such a country you cannot use the Service or your account.
Features. Where the Service is open, packs (including the daily free pack and packs given as rewards), the Marketplace, the card scanner and the Market Values pages, and Live are each offered only in the countries we choose. We may add or remove a country for the Service or for any of these features at any time. What you can use depends on the country you are in when you use the Service, as shown by your internet connection; using a VPN, proxy or similar to get round this is a breach of these Terms (section 3).
Your vault and withdrawals. Wherever the Service is open to you, you can still see a pack you have already paid for being opened, ship or sell what is in your vault, and follow your Marketplace orders, even where packs or the Marketplace are not offered. Withdrawals are available only in countries where packs are offered, except for approved vendors (section 16), who can withdraw wherever the Service is open. If a change to where the Service or packs are offered stops you withdrawing money that you could withdraw before, write to support@thecollectibles.io and we will tell you how you can receive it.
The waitlist. Our pre-launch waitlist takes no new sign-ups. If you joined it, you can leave it at any time with the unsubscribe link in any waitlist e-mail or by writing to support@thecollectibles.io.
03Eligibility
To use the Service you must:
be at least 18 years old, or older if the age of majority where you live is higher. By creating an account you confirm that you are. The app asks for your date of birth when you sign up, and the website's sign-up form asks you to confirm that you are 18 or older; we may also ask for your date of birth before you add money, buy or open a pack. Once given, your date of birth cannot be changed in the Service; we use it only to confirm your age and remove it when you delete your account;
use the Service only where it is lawful for you to do so and where we offer it (section 2);
not be subject to sanctions or other restrictions under the laws of the United States, the European Union or the United Kingdom that would prevent us from dealing with you;
not have had an account suspended or closed by us, unless we agree otherwise in writing.
You may hold one account only. Accounts are personal and may not be sold, lent or transferred. Using a VPN, proxy or other means to hide your location or to get around a restriction is a breach of these Terms.
04Your account
You are responsible for keeping your login details private and for everything done through your account. Tell us at support@thecollectibles.io as soon as you suspect someone else has used it. In the app, Settings → Security shows your two-factor settings and your signed-in devices.
You must give us accurate details and keep them up to date, including any delivery address you add. Your username is public; choose one that does not impersonate anyone.
When you register, we confirm your email address, check that you are 18 or older and check your location. You do not need to provide identity documents to buy or open packs.
Before your first payout, buy-back cash-out or physical order, you must complete identity verification through our verification partner. Our verification partner will ask for your full name, date of birth, residential address and phone number, a government-issued photo ID and a live selfie check, and may ask for proof of address. Our verification partner processes this information under its own terms and privacy policy, and shares the result with us.
We may also ask you to verify your identity again, or to provide more information such as the source of your funds, where the law or one of our payment partners requires it, where our checks flag your account, or where your details change or your documents expire. We may pause payouts, cash-outs, orders or other affected features until the check is complete.
The name on your verified identity must match the payment method or payout account you use. We only pay out to an account or payment method in your own name. If you cannot be verified, refuse verification or give us false information, we may close your account. Any refundable balance will be returned only to the original payment method.
05The app: your licence to use it
We grant you a personal, limited, non-exclusive, non-transferable, revocable licence to install and use the app on devices you own or control, for your own personal use and, if you take part in the creator, Partner or Vendor programme, for that programme, under these Terms and the usage rules of the app store you got it from.
You may not copy, modify, translate or create derivative works of the app; reverse engineer, decompile or disassemble it, except to the extent the law expressly permits; rent, lease, sell, sublicense or otherwise transfer it; remove or obscure any proprietary notice; or use automated means to access, scrape or extract data from the app or our services, or to get around rate limits or other technical restrictions.
The app uses the camera, the photos you choose, the microphone (on iPhone, to record clips), motion sensors and notifications only for the features described in the Privacy Policy. The app reads cards on your device and looks the text up in our card database and in public card catalogues. The picture of a scan that found nothing, was uncertain or failed, or whose result you dismissed, corrected or reported, is uploaded so we can improve recognition, also when you are not signed in. Recognition is automated and can misread a card; check the result before you rely on it.
06Packs and odds
A pack is a randomised product. Each pack you buy gives you one physical collectible selected at random from that pack's pool: a trading card graded and encapsulated by a professional grading company (for example PSA, BGS, CGC or SGC) or, in some pools, another collectible such as a sealed case. The items are physical and held in a vault before they are selected. We do not grade cards ourselves and rely on the grade stated on the slab.
Before you buy, the pack page shows the price, the lowest and the highest value in the pool, and the pack's top items with the probability of pulling each. The values shown are estimates (section 13): what you get if you sell an item is its Sell price at that moment (section 9), and we do not promise that any item will be worth any particular amount. Our fulfilment partner divides the pool into value bands, each with its own probability, and selects the item using those band probabilities; the probability shown for a single item assumes that every item in its band is equally likely. The pool changes as items are pulled and restocked, so these figures can change from one purchase to the next.
You buy one pack from that pool, not a specific item: which item you receive follows the published odds, and other users' results say nothing about yours. A pool may include items worth considerably less than the pack price as well as items worth considerably more.
07Balance, deposits and withdrawals
Prices are shown in US dollars. The app can also show card values in euros or yen, converted at the day's reference rates. You pay for packs, shipping and Marketplace items from your balance.
Deposits. You add money to your balance by card or another method offered when you pay, such as Apple Pay or Google Pay, through our payment partner. You enter your payment details in our payment partner's own form, shown on our website or opened from the app, or in your phone's wallet; we never see or keep your card number. Deposits are limited per payment and per rolling 24 hours, with lower limits for accounts younger than seven days; if a deposit would go over a limit, we tell you which one.
Your balance. Your balance is a prepaid credit for use on the Service. It is not a bank deposit, does not earn interest and is not covered by any deposit protection scheme. Money you add can be spent on packs, shipping and the Marketplace but cannot be withdrawn. The proceeds of your sales, including the automatic sale in section 9, can be withdrawn. When you pay for something, money that cannot be withdrawn is used before withdrawable money. A refund of a Marketplace order or of a shipping fee goes back the way it was paid: what was paid with money that cannot be withdrawn comes back as spendable balance, and what was paid with withdrawable money comes back withdrawable. The refund of a pack purchase that could not be completed is returned as spendable balance. Promotional credit, for example from a promotion code, can be spent but not withdrawn.
Withdrawals. You withdraw from your withdrawable balance through our payout partner, on its own pages: our payout partner verifies your identity and the payout destination, such as a bank account or debit card in your name. We may also ask you to verify your identity before we pay out a withdrawal (section 4). Withdrawals are available only in the countries described in section 2. The minimum amount, any fee and the expected arrival are shown before you confirm. Every withdrawal is reviewed by our staff before it is sent, and it may be held or refused, for example while we look into a possible breach of section 19 or if a verification fails. In normal cases a withdrawal reaches your bank account within 4 to 7 business days of your request. It can take longer when a verification is still pending, when our payout partner or your bank needs more time, or when a withdrawal is held for review, and we do not promise an arrival date. If a withdrawal is refused, fails or is returned, the amount comes back to your withdrawable balance.
If you believe a payment is wrong, contact us before raising a chargeback with your bank. A chargeback on a completed purchase or a shipped order may lead us to suspend your account while we investigate.
You are responsible for any taxes that apply to you because of your purchases, sales, shipments or Marketplace orders. Where we are required to collect VAT, sales tax or similar on a purchase or shipment, it is shown before you confirm.
08Buying a pack, refunds and the right to withdraw
Buying a pack opens it: the item is selected and assigned to your account at the moment of purchase, and the reveal only shows it to you. Once the item has been selected, the purchase is final and cannot be cancelled, exchanged or refunded.
If a purchase fails after your balance was charged — for example because our fulfilment partner cannot complete it — the amount is returned to your balance, usually within an hour.
If you are a consumer in the European Economic Area or the United Kingdom, you have a statutory right to withdraw from a distance contract within 14 days. Because the item is selected and assigned to you as soon as you buy a pack, you ask us to perform the contract straight away and acknowledge that you lose the right to withdraw from that purchase once the item has been selected. This does not affect your rights if an item you receive is not as described or arrives damaged (section 11).
09Selling and the automatic sale
Selling. You can sell an item from your vault while its Sell option is open. When you sell, we sell the item for you to our fulfilment partner; a sale is not a refund of the pack. The Sell price is set when you sell: it is our fulfilment partner's current offer for that item, less any fee we take, or, where we have set one for a pack, a fixed share of the item's value. Before you sell, the vault shows an estimate based on the item's value when you pulled it; the amount you receive is fixed when the sale completes and is shown to you then, and it can differ from the estimate. A sale may take some time to complete. The proceeds are credited to your balance and can be withdrawn under section 7. A sale is final, and the item is no longer yours once the sale completes.
An item can be sold only for a limited time after its pack is bought. When that time has passed, the Sell option for that item closes; the item stays in your vault and can still be shipped to you until the automatic sale.
Selling is a convenience we offer, not an obligation. We may change how the Sell price is set, or pause or withdraw the Sell option for an item, pack or category; changes apply only to sales made after the change.
Automatic sale after four days. An item in your vault is sold for you if, four days after you bought its pack — whether or not you have watched it being revealed — or four days after it came back to the vault from a cancelled or failed shipment, you have neither sold it nor ordered it shipped. The automatic sale works like a sale you make yourself: the item is sold to our fulfilment partner at its Sell price at that moment, as described above, the proceeds are credited to your balance, the sale is final, and we send you a receipt by e-mail. We also e-mail you the day before an item is sold for you. An item with an open shipping order is not sold automatically. If our fulfilment partner makes no offer for an item at that moment, because its Sell option has closed or the partner will not buy that item, the item stays in your vault: we offer it again each day, and you can still ship it, or sell it yourself while its Sell option is open. Items bought on the Marketplace do not go into the vault and are outside the automatic sale. The vault shows the date on which each item will be sold for you.
10The vault
The item selected for you when you buy a pack is yours from that moment, whether or not you have watched it being revealed. Until you ship it or it is sold, it stays in a vault run by our fulfilment partner or the vault operators it works with, where it is held for you and linked to your account by an internal identifier and, for a graded card, the slab's certification number. Our fulfilment partner states that the items in its vaults are fully insured.
Vault storage is free. An item stays in the vault until you ship it or it is sold, including by the automatic sale four days after the purchase of its pack or after its return from a cancelled or failed shipment (section 9).
If an item is lost or damaged while it is in the vault, we will pay you its market value at the time of the loss or replace it. If a vault operator stops operating or breaches its obligations, we will work with our fulfilment partner to move the affected items to another vault, and we will tell you if this affects an item of yours.
Items the vault no longer holds. If our fulfilment partner cannot find an item in your vault when you sell it or when it is due to be sold for you, or if our daily check of the partner's vault misses it on two days in a row, we remove the item from your vault and tell you. We treat it as an item lost in the vault: we pay you its market value at the time of the loss or replace it, as the paragraph above says.
11Shipping from the vault
You can ship any item in your vault to yourself. To ship we need the recipient's name and a complete delivery address in Latin characters; the app also asks for a phone number for the carrier. We can only ship where our fulfilment partner delivers; the shipping quote tells you whether your address can be served.
The shipping fee is shown before you confirm and is charged to your balance. The carrier's estimated delivery time is shown with the quote; it is an estimate, and customs clearance can add time. Once you confirm the shipment of an item pulled from a pack, it cannot be cancelled or redirected. Our fulfilment partner states that every shipment from its vaults is tracked and insured. We e-mail you when your shipment is labelled, shipped and delivered.
If a shipment is cancelled or fails, including after it has left the vault, the items return to your vault, the shipping fee is refunded to your balance, and a new four-day period under section 9 starts from their return.
You are responsible for any customs duty, import VAT or other charge levied where you live; carriers may collect these before delivery. Risk of loss or damage passes to you when the shipment is delivered. If an item arrives damaged, tell us within 7 days of delivery, with photographs of the item and its packaging, so that a claim can be raised with our fulfilment partner; a covered loss or damage is reimbursed at the item's market value or, where possible, the item is replaced. If your shipment has not arrived within 10 business days of dispatch, or tracking stops moving for more than 5 business days, contact us and we will ask our fulfilment partner to investigate.
12The Marketplace
The Marketplace sells graded cards and other items held by shops: our own shops, and outside shops that have passed our business verification. Every listing shows which shop sells it. You add items to a cart and pay at checkout from your balance; if your balance is short, you can top it up by card, Apple Pay or Google Pay, and your orders are placed once that payment arrives. One order is created per shop, and each shop ships its own order to your door; items bought on the Marketplace do not go into the vault. Checkout needs a delivery address in Latin characters and a phone number for the carrier.
Who you buy from. When you buy from one of our own shops, we are the seller. When you buy from an outside shop, the sales contract for the goods is between you and that shop, which is named as the seller of record on your order with its legal name, registered address and VAT number where it has one. We run the Marketplace, take the payment and settle with the shop after deducting our commission. We are not a party to an outside shop's sale, but we stay your point of contact: write to support@thecollectibles.io about any order and we will take it up with the shop.
Listings. Shops are responsible for the accuracy of their listings, including grade, grading company, certification number and condition. Values shown beside a listing are estimates (section 13). If an item is not as described, tell us within 7 days of delivery.
Shipping. The shipping charge is shown before you pay. You are responsible for customs duty, import VAT or other charges levied where you live. Risk passes to you on delivery.
Cancellation and refunds. You can cancel an order on its order page until the shop marks it shipped; the full amount returns to your balance. If a shop does not ship in time, we may cancel the order and refund you. We may also refund an order after shipping or delivery where the item was not as described, was damaged or did not arrive; we decide these cases and may recover the amount from the shop. Refunds go to your balance under the refund rule in section 7.
Consumers in the European Economic Area and the United Kingdom. You also have a statutory right to withdraw from a Marketplace purchase within 14 days of receiving it, without giving a reason. Write to support@thecollectibles.io within that period; we will give you the return instructions and arrange the refund with the shop. You pay the cost of returning the item unless it was wrong or damaged, and you are responsible for it until it arrives back.
13Market values
The value shown for an item in your vault is our fulfilment partner's market value for it at the time you pulled it; it is not updated afterwards. Values on card pages, price charts and sales history come from card-price catalogues through our card database and are refreshed regularly. Values are estimates, not appraisals, offers or financial advice, and the value of any card can fall as well as rise. Card data comes from third-party catalogues and may be incomplete, delayed or wrong. The only price we commit to is the amount a sale credits to you when it completes.
14Live
Watching. Live shows creators opening packs. You can follow a channel, get an e-mail when a creator you follow goes live (you can turn notification e-mails off in your settings), and talk in the channel's chat room. Chat is public to everyone in the room, and section 17 applies. You can remove your own messages, a creator can remove messages in their room, and we can remove messages, slow a room down or turn its chat off.
Opening a pack on a stream page. A pack you buy from a stream page is your own purchase under these Terms and counts toward the creator's revenue share; the creator does not see your payment details. A pack bought from the stream page's side panel opens for you alone. If the creator has switched their stage on, you can choose to open a pack on the stage instead, where everyone watching sees it open with your username.
Being a creator. Streaming is by invitation: you can apply from your profile with a short message, and if we decline you can apply again after 30 days. If we approve you, you get a channel with its own page, chat room and stream key. As a creator you must: keep your stream key secret and tell us at once if it leaks; stream only content you have the right to stream (music, video and other people's images included); not stream anyone under 18; follow section 17 in everything you show and say; and not misrepresent the packs, the odds, the Sell prices or our relationship. Streams are recorded and shown as replays on your channel page; recordings are deleted automatically after the retention period set with our video provider, or earlier if we remove them. By streaming you grant us the licence in section 17 for the stream and its replays. We may end a stream, remove a replay, hide a channel or withdraw the creator role if these Terms are breached.
Revenue share and your link. A creator earns a share of the packs bought from their stream page. The percentage is set by us, shown in the Creator Studio, and may change with notice; we pay it in the way and at the time we agree with you. Your channel link carries your referral code, so sign-ups through it are attributed to you under section 18. Nothing in this section makes you our employee, agent or partner in law.
15Partner programme
Collectors who create content can apply to the Partner programme from the Partners page with their name, country and social media handles. We decide applications at our discretion and may decline without giving a reason; a declined applicant may apply again after 30 days.
An accepted partner signs the Partner Agreement in the Partner Profile by typing their full name and confirming that they are 18 or older. That agreement governs the partnership: the welcome kit, missions, rewards and what you may and may not say about us. A kit can only be ordered, and a mission submission only made, after the agreement is signed. Rewards are free packs under section 18; the free packs themselves cannot be bought, sold, transferred or exchanged for money. A kit is shipped to the address you give and is not for resale.
When you submit a post for a mission you confirm that the post is yours, that it complies with section 17 and the law, and that you have made every disclosure the advertising rules of your country require about your relationship with us (for example "#ad" or "paid partnership"). We may link to or embed your public posts on our pages. We may remove you from the programme, void a mission and take back a reward for a breach of the agreement or these Terms.
16Vendor programme
A collector who wants to sell on the Marketplace applies from the Vendors page with a shop name and country. Selling requires business verification: the form and documents described in the Privacy Policy. We may approve, reject or suspend a shop at our discretion and withdraw vendor status at any time for a breach.
As a vendor you: list only items you hold and own, described accurately and lawfully; ship every paid order within the dispatch time your shop promises (at most three working days), with tracking, to the address on the order; are the seller of record and responsible for the goods, for consumer rights in the buyer's country and for your own taxes and invoicing; and accept that your legal name, city and country are shown on your shop page and that your legal name, full registered address and VAT number are shown on every order a buyer places with you — if you trade as a sole trader, that may be your home address. You must not contact buyers for anything other than the order or use their details for any other purpose.
We take a commission on each sale at the rate stated when your shop is approved, which may change with notice. We record your net proceeds in your vendor ledger and settle them after the settlement period we set (currently 21 days after shipping within one country and 30 days across borders). Vendor payouts are not running yet; we will tell you before they start. We may deduct refunds, chargebacks and costs caused by your breach, including from later sales, and an order we refund after settlement is owed back by you. A suspended shop is taken off the Marketplace at once, but its paid orders must still be shipped.
17Community and user content
Zero tolerance. We do not tolerate objectionable content or abusive users anywhere on the Service — in posts, comments, direct messages, chat rooms, streams, profiles, shop listings, mission submissions or anything else you upload or say. You accept, as a condition of using the Service, that we may remove content and end your access without notice for a breach of this section.
You must not post, send, stream or list anything that:
is unlawful, defamatory, threatening, harassing, hateful, discriminatory, sexually explicit or gratuitously violent, or that sexualises, exploits or endangers a minor;
bullies, stalks, doxes or targets another person, or reveals someone's personal information without consent;
promotes self-harm, terrorism, violent extremism or dangerous activities;
is spam, a scam, a pyramid scheme, unauthorised advertising or repeated unsolicited contact;
impersonates anyone or misrepresents your affiliation with a person or organisation, including us;
infringes someone else's copyright, trade mark, privacy or other rights, or that you do not have the right to share;
contains malware, or interferes with the security, integrity or availability of the Service;
misrepresents a card, a pack, the odds, a Sell price or a market value, or is used to manipulate prices or trades;
evades a block, a suspension, a removal, or the rules of a chat room.
Your content and our licence. You keep ownership of everything you create — your posts, images, clips, messages, streams and replays, listings and profile ("your content"). You grant us a worldwide, non-exclusive, royalty-free licence to host, store, reproduce, adapt for display, transmit and publicly display your content, solely to operate and promote the Service and the features you use it in, including showing it to other users and, for public content, on our pages. The licence ends when you delete the content. It continues for comments and messages you leave on the Service when you delete your account (they stay visible without your name until we remove them), for copies already shared with other users, for copies we keep for moderation and legal purposes as set out in the Privacy Policy, and for backup copies until they expire (at most 14 days). You are responsible for your content and confirm that you have the rights necessary to share it.
Reporting. Report anything that breaks these rules with the Report control on the post, comment, message or profile in the app, or by writing to support@thecollectibles.io with enough detail for us to find it. On the website, a Live channel can be reported with the Report button on its stream page. Live chat messages, and Live streams in the app, have no Report control yet: write to us with the channel name and the time. We review every report promptly. When content breaks these rules we remove it, and we warn, restrict, suspend or close the account of the person who provided it; for serious breaches we suspend the account straight away. Where the law requires, we report content to the authorities.
Blocking. In the app you can block any collector from their profile, a post, a comment or a message: a blocked collector cannot follow you or message you, you both stop following each other, and neither of you sees the other's posts, comments or messages. Blocking works in the app; it does not yet apply in Live chat rooms. You can also make your profile private so that only your followers see your posts.
Our decisions. We may remove or hide content, restrict features, suspend an account so that it can no longer be used, or close it, and refuse to reinstate it, when we believe in good faith that this section, the law or someone's rights have been breached. Where we do so we will tell you the reason unless the law prevents it or telling you would put someone at risk, and you may contest the decision by replying to that notice. We may also remove content that is lawful but that we consider unsuitable for the Service.
Child safety. We do not allow content or behaviour that sexualises, exploits or endangers a child anywhere in the Service. We remove it as soon as we find it, close the account responsible, keep what the law requires us to keep, and report apparent child sexual abuse material to the National Center for Missing & Exploited Children (NCMEC) and to other authorities where the law requires. Child-safety contact: support@thecollectibles.io.
Copyright complaints. If you believe content on the Service infringes your copyright, write to support@thecollectibles.io identifying the work, the material in question and your contact details, and confirming that you are the rights holder or authorised to act for them.
18Promotions, missions and referrals
We may offer promotions, promotion codes, missions or referral rewards. Each has its own rules, which we publish with it; the official rules below apply to all of them. Promotional credit and free packs may be limited in use and may expire, as shown with them. Our employees and those of our fulfilment partner, and members of their households, may not take part.
Daily free pack. No purchase or payment is needed. Registered users who meet section 3 and are in a country where packs are offered (section 2) can claim one free pack a day. The pack opens at 12:00 noon in the time zone of your account and stays open for the window shown (currently eight hours). A new account’s first pack can be claimed at once. One account per person. You receive one pack of the kind shown in the offer; its item is selected from that pack’s pool in the same way as for a bought pack, and is then yours under sections 9 to 11. A free pack is a promotion, not a purchase: the free pack itself cannot be bought, sold, transferred or exchanged for money. We choose which pack is offered and may change, pause or end the offer, or exclude an account from it, at any time and without notice, including an offer shown but not yet claimed. We may also end the daily free pack entirely, for everyone or for a country, at any time and without notice; no one has a claim to a free pack that has not been opened.
Missions and referrals. Every collector has a personal invite link and code, shown in your profile under Refer a friend. A friend is referred by you when they create their account through your link or enter your code when signing up; a referral cannot be added afterwards. Each mission states what it asks for, the free pack it pays, how often it can be earned and how long you have to open the pack. The current missions are:
Invite 3 friends. Every three referred friends who confirm their e-mail address earn you one free pack of the kind offered as the daily free pack, to be opened within the time shown with it. A sign-up alone does not count.
Invite a friend who deposits. Every referred friend whose first deposit is USD 10 or more earns you one Unmarked Pack — Pokémon, a pack priced at USD 10. You must open it within 7 days of earning it, after which it expires. You can earn this reward once per friend, up to five times in a calendar month and ten times in total.
A friend can count toward both missions, but only once for each. A friend counts only if they meet section 3, are in a country where packs are offered and use an inbox that is not yours; addresses that differ only in capital letters, a “+” tag or, for Gmail, dots count as one inbox. You must also be in a country where packs are offered to receive or open a reward. Friends who signed up before a mission started do not count. If a qualifying deposit is refunded, reversed or charged back, we may void the reward and any item pulled from it. A pack’s price says nothing about the value of the item it contains: the item is selected from the pack’s pool under section 6.
Rewards are free packs: they have no cash value, cannot be transferred, sold or exchanged for money, and expire as shown. We decide at our discretion whether a referral, a friend or a reward qualifies, and we may change, pause or end a mission, its requirements, its reward or the programme at any time and without notice. A reward already earned is honoured unless this section allows us to void it. All rights are reserved.
Promotion codes. A promotion code may add promotional credit to your balance, which can be spent but not withdrawn. It may instead give a discount on the price of a pack, applied when you open it and limited as shown with the code (for example to a first purchase, a number of uses or a date). We may withdraw a code at any time.
Achievements. The badges shown on your profile in the app are recognition only and carry no reward.
Misuse. Where a free pack or reward was obtained through misuse, we may void it and any item pulled from it, and section 19 applies. Misuse includes using several accounts, addresses that reach the same inbox, automation, paid sign-ups or any other attempt to game a promotion.
Sponsor. Every promotion is offered by Horde Inc. (section 30). Apple Inc. and Google LLC are not sponsors of, and are not involved in, any free pack, mission, referral reward or other promotion. Questions: support@thecollectibles.io.
19Acceptable use
You must not:
break any law that applies to you, including sanctions, anti-money-laundering, consumer and tax law;
use the Service to launder money or to convert funds you are not entitled to;
open more than one account, or use another person's account, payment method or identity;
raise chargebacks on completed purchases, or otherwise abuse payments;
exploit a bug instead of reporting it, or interfere with how packs are sold, opened or priced;
use bots, scripts or automated tools to buy, open, sell, list, post, message or scrape;
hide your location to get around a restriction;
abuse promotions, missions or referral programmes;
harass, threaten or defraud other users, creators, shops or our staff;
upload malware or attack the security or availability of the Service.
20Intellectual property
The Service, including its software, design, text, images, animations, the app, and The Collectibles names and logos, belongs to us or our licensors. You get the licence in section 5 and nothing more. You may not copy, modify, distribute, reverse engineer or resell any part of it, or remove any proprietary notice.
Trading cards, their artwork, set names and brand names belong to their rights holders (for example The Pokémon Company, Bandai, Toei Animation, Konami, Riot Games, Wizards of the Coast, Topps, Panini and the sports leagues and athletes). Buying a card gives you the physical card only; it gives you no rights in the artwork, characters or brands printed on it. The Collectibles is an independent service and is not affiliated with, endorsed, sponsored or approved by any trading card publisher or grading company; their names and pictures of their cards are used only to identify cards.
If you send us ideas or feedback, we may use them without owing you anything.
21Availability and changes to the Service
We aim to keep the Service available but do not promise uninterrupted access. We may change, suspend or withdraw any feature, pack, destination or programme. Changes do not affect items you already own, a sale that has already completed, a shipment already confirmed or an order already paid.
22Suspension and closure of accounts
You may close your account at any time in the app (open your profile, tap the gear icon, then Account → Your data → Delete account) or by writing to us; thecollectibles.io/account-deletion explains the process. Closure is refused while there is money on your account — your balance, including any amount credited to you but not yet claimed — or while a withdrawal is pending; withdraw or spend what is left first. Items in your vault do not stop the closure, but every item still in the vault is sold for you under section 9 at its Sell price at that moment, and the proceeds are credited to the closed account, where we cannot pay them out to you; ship or sell your items before you close.
We may pause purchases on your account, or suspend or close it, if you breach these Terms, if a payment provider, a law-enforcement request or a legal obligation requires it, or for security reasons. A suspended account cannot be used. Where the law allows, we will tell you why and you may respond.
If we suspend or close your account, the items in your vault are sold for you under section 9 and the proceeds are added to your balance, and we will contact you at your account e-mail address about returning your balance to you. Where an account is suspended for fraud or sanctions reasons, we may hold its balance until the matter is resolved or a competent authority tells us what to do with it.
23Disclaimers
The Service is provided as it is. To the extent the law allows, we make no promise that it will be error-free, that card recognition or market values will be correct, that any card will hold or gain value, that the Sell option will be available for a given item at a given time, or that any creator, shop or other user will act as they should. Nothing in this section removes rights you have as a consumer that cannot be excluded.
24Limitation of liability
To the extent the law allows, our total liability to you for all claims connected with the Service in any 12-month period is limited to the greater of (a) the amount you paid us in the 12 months before the claim and (b) the market value of the items affected by the claim at the time of the loss. We are not liable for indirect losses such as lost profits, for losses caused by events outside our reasonable control, or for the acts of other users, creators or outside shops beyond what section 12 provides.
Nothing in these Terms limits our liability for death or personal injury caused by negligence, for fraud, for intentional or grossly negligent breach, or for anything else that cannot be limited under the law that applies to you.
25Indemnity
If you are not a consumer, you will compensate us for losses, costs and claims that arise from your breach of these Terms or of the law. Every user is responsible for their own content and for claims that arise from it.
26Governing law and disputes
These Terms are governed by the laws of the State of Delaware and the federal laws of the United States, without regard to conflict-of-law rules. Any dispute we cannot resolve together will be brought in the state or federal courts located in New Castle County, Delaware, and you and we consent to the jurisdiction of those courts. If you are a consumer living in the European Economic Area or the United Kingdom, you also keep the protection of the mandatory consumer laws of your country of residence, and you may bring a claim in the courts of that country.
Talk to us first: write to support@thecollectibles.io and we will try to resolve any issue within 30 days. Consumers in the European Economic Area or the United Kingdom may also refer a dispute to the consumer dispute body of their own country.
27App store terms
Apple App Store. These terms apply if you got the app from the Apple App Store and prevail over any conflicting term to the extent of the conflict. This agreement is concluded between you and Horde Inc. only, and not with Apple Inc. ("Apple"); Horde Inc., not Apple, is solely responsible for the app and its content. The licence in section 5 is limited to a non-transferable licence to use the app on any Apple-branded products that you own or control and as permitted by the Usage Rules in the Apple Media Services Terms and Conditions, except that the app may be accessed and used by other accounts associated with you via Family Sharing or volume purchasing; everyone who uses the Service must still meet section 3 and hold their own account. Horde Inc. is solely responsible for providing any maintenance and support for the app, as stated in these Terms or as required by law; Apple has no obligation whatsoever to furnish any maintenance or support services for the app. Horde Inc. is solely responsible for any product warranties, whether express or implied by law, to the extent not effectively disclaimed. If the app fails to conform to any applicable warranty, you may notify Apple, and Apple will refund the purchase price of the app to you (if any); to the maximum extent permitted by law, Apple has no other warranty obligation with respect to the app, and any other claims, losses, liabilities, damages, costs or expenses attributable to any failure to conform to any warranty are Horde Inc.'s sole responsibility. Horde Inc., not Apple, is responsible for addressing any claims by you or any third party relating to the app or your possession and use of it, including (i) product liability claims; (ii) any claim that the app fails to conform to any applicable legal or regulatory requirement; and (iii) claims arising under consumer protection, privacy or similar legislation. If a third party claims that the app or your possession and use of it infringes that third party's intellectual property rights, Horde Inc., not Apple, is solely responsible for the investigation, defence, settlement and discharge of that claim. You represent and warrant that you are not located in a country that is subject to a US Government embargo or that has been designated by the US Government as a "terrorist supporting" country, and that you are not listed on any US Government list of prohibited or restricted parties. You must comply with applicable third-party terms of agreement when using the app. Apple and Apple's subsidiaries are third-party beneficiaries of this agreement, and on your acceptance of these Terms Apple will have the right (and will be deemed to have accepted the right) to enforce them against you as a third-party beneficiary. Questions, complaints or claims about the app: Horde Inc., 2810 N Church St, STE 90840, Wilmington, Delaware 19802, United States; support@thecollectibles.io.
Google Play. If you got the app from Google Play, your use is also subject to the Google Play Terms of Service. Google is not a party to this agreement and is not responsible for the app. Where these Terms conflict with the Google Play Terms of Service in respect of your acquisition of the app, the Google Play Terms of Service prevail to the extent of that conflict.
Everything you pay for in the Service is a physical good or a service for one: packs (each one a physical collectible), shipping and Marketplace items. You pay with your balance, funded through our payment partner by card, Apple Pay or Google Pay, not through Apple's or Google's in-app purchase; your balance cannot be spent on anything digital.
28General
If any part of these Terms is found invalid, the rest continues to apply. We may transfer our rights and obligations under these Terms to a successor business; we will tell you if we do. These Terms, the Privacy Policy, the Partner Agreement where you have signed one, and the rules of any promotion are the whole agreement between us about the Service. They are written in English; translations are for convenience and the English text prevails. Sections 9 to 13, 17, 20 and 22 to 27 survive the closure of your account.
29Changes to these Terms
We may update these Terms at any time by posting the updated version on the website and in the app; the date at the top shows when they changed. We are not obliged to notify you of a change individually, except where the law requires notice, in which case we give it in the way the law requires. If you keep using the Service after the updated Terms are posted, you accept them. If you do not accept them, stop using the Service and close your account.
